The accident happened at about 3:00 a.m. at the intersection of Collings Road and Essex Street in Gloucester City.

All train traffic was temporarily halted due to the cars on the tracks.

Passenger Injuries in New Jersey

Gloucester City, NJ - Two Cars Collide on Railroad Tracks at Essex St and Collings Rd

It is not uncommon for the person liable for the accident to be the driver of the car in which you were riding. For instance, the driver may be a child, parent, spouse, or another relative of the injured passenger. The victim could also be a colleague or a friend. As long as the two parties are not on the same insurance policy, the claim is valid.

Filing a claim of personal injury against a relative or a friend might be uncomfortable but passengers are entitled to seek economic recovery when their injuries were caused by someone’s negligence. In the majority of cases, the negligent driver’s insurance will cover the damages.

If you sustained injuries as a passenger during a car accident, you are entitled to pursue financial compensation for your medical costs and other damages just as an injured driver would be. This is true no matter the cause of your accident, whether it was driver negligence, vehicle defect, or a road hazard.
