A Neptune City man will spend almost five-years (57-months) in prison following a guilty plea in Trenton Federal Court and sentencing to being a felon in possession of a firearm and unlawful possession a machine-gun, Acting U.S. Attorney Racheal Honig announced on Monday.
He was also sentenced to three years of supervised release.
Davon Harley, 30, found himself in trouble in February of 2020.
He was arguing with several other people outside of an apartment complex and when he saw Neptune City Police approach him, Harley booked it on foot and discarded a handgun in the process.
Attorney Honig adds that police later discovered that the handgun had been altered to fire exclusively in fully automatic mode and had a magazine capable of holding 31 rounds of ammunition.
Law enforcement officers including from the Neptune Township and Asbury Park police departments, found Harley, the machine-gun and a magazine he also discarded which contained 22 rounds of ammunition.
Attorney Honig said that this case is part of Project Guardian, a DOJ program with a goal of reducing gun violence and enforcing federal firearms laws.
The government is represented by Special Assistant U.S. Attorney Christopher Matthews of the U.S. Attorney’s Office’s Criminal Division in Trenton.
